City Ups Fines On Businesses That Fail To Clear Sidewalks

After decades of trying to find a successful way to get owners of Des Plaines businesses to clear snow and ice from their sidewalks, city council members think they’ve found the solution.

Aldermen last week approved amendments to the snow removal ordinance that increases monetary penalties for failing to comply and sets specific times when snow must be removed and the width of shoveled snow paths.

The changed, stricter ordinance specifies that when 2 or more inches of snow falls, the businesses have 24 hours after the event to clear a path on sidewalks at least 3-ft. wide. If the ice and snow cannot be removed within that time period because of its depth or difficulty removing it, the business must spread sand, salt or other materials to prevent slipping.

The city’s fine for non-compliance for many years has been a maximum of $250. Under the new provisions, first time offenders will be fined $250, followed by $500 for the second infraction, and $750 for the third. Any days when snow is not cleared after three days, a separate fine will be assessed.

The change, aldermen hope, will improve safety conditions for pedestrians who in the past have had to walk in the street.

“It’s a crime to see people standing out on Lee Street waiting for a bus,” said Ald. John Robinson. “To hell with a notice.” He was referring to a proposal by Ald. Mike Charewicz (8th) to first give violators a written notice that they are not in compliance before giving a ticket and a fine amount. Aldermen rejected Charewicz’s suggestion.

Businesses that are ticketed for not removing snow and ice can appeal the citation in the city’s administrative court that’s held monthly in city hall.
