Village Adds Time Limits On Construction Noise

Mt. Prospect village trustees recently established an ordinance amending an existing chapter in the building code that prohibits nighttime construction between 7 p.m. and 7 a.m. seven days a week.

In February 2008, village staff presented the village board recommendation to the noise ordinance regarding amplified noise, noise generated through residential area deliveries, and a modification to the nighttime construction regulations.

The village board approved the revised ordinance in April 2008. However, a resident recently came forward to the village board to complain about the construction noise generated through Randhurst redevelopment activities, prompting a review of the noise ordinance to address the resident's concerns.

It was found through the review the restriction on nighttime construction between 7 p.m. and 7 a.m. was inadvertently removed from the ordinance when other changes were made in April 2008.

"The ordinance now reads: "Construction related activity shall mean any use of percussion or power tools, excavation, demolition and of moving powered construction equipment and the loading or unloading of construction material or equipment. If work within the prohibited hours is necessary to protect health, safety or property, an owner may apply to the village manager for an emergency work permit."

Emergency work permits may be issued for the minimum time necessary to complete the emergency work up to a maximum of three days. The permit may be renewed for periods up to three days while the emergency continues. The person actually committing the violation, the general contractor, the permitee, the property owner and the property occupier, shall be jointly and severally liable for any violations."
